Terms of service

These terms cover your use of Seekpitch at seekpitch.com and app.seekpitch.com. The short version: you send from your own mailboxes, so you're responsible for what goes out and for following the email laws where you and your leads are.

1. The agreement

Seekpitch ("we", "us") provides an AI agent that researches companies, writes outbound emails and sends them from mailboxes you connect. By creating an account or using the service you agree to these terms and to our privacy policy. If you use Seekpitch for a company, you confirm you can accept these terms for it, and "you" means that company too.

Seekpitch is for business use by people aged 18 or over. It isn't meant for emailing consumers.

2. Your account

Keep access to your sign-in email and connected accounts secure. You're responsible for what happens in your workspace, including what people you invite do there. Tell us at hello@seekpitch.com if you think someone else has got in.

3. Trial, plans and billing

• New workspaces get a free 30-day trial with 50 qualified leads. No card is needed, and nothing is charged when it ends.
• Paid plans are billed monthly in advance. Payments are processed by Dodo Payments, our merchant of record, which also handles sales tax and VAT. Their terms apply to the payment itself.
• Each plan includes a number of qualified leads a month, as described on the pricing page. When you reach it, the agent stops finding new leads until your next billing month; everything else keeps working.
• You can change plans at any time, and the difference is prorated. You can cancel at any time from the billing portal and keep your plan until the end of the period you've paid for. We don't refund partial months; see the refund policy.
• If we change prices, we'll email you at least 30 days before the change applies to you.

4. You are the sender

Emails go out from mailboxes you own, under your name and domain, after you approve the leads and first emails. That makes you the sender, and you're responsible for following the laws that apply to you and to the people you contact. Depending on where they are, that can include CAN-SPAM in the US, CASL in Canada, and the GDPR, ePrivacy rules and PECR in the EU and UK. Among other things, this means:

• Emailing only business contacts, and only where the law allows it without consent.
• Identifying yourself honestly, and including a postal address in your emails where the law asks for one.
• Honouring opt-outs. Seekpitch adds an unsubscribe link and stops emailing anyone who uses it or replies to unsubscribe, but you must not contact them another way.
• Having a lawful reason to process the personal data of the people you contact.
• Following the terms of your mailbox providers, such as Google, Microsoft or Zoho.

Seekpitch gives you tools that help (warm-up, daily caps, unsubscribe handling and bounce handling), but they don't make your outreach compliant on their own.

5. LinkedIn

LinkedIn steps are optional. If you connect your LinkedIn account, you authorise the agent to send connection requests and messages from it to leads you've approved, up to the daily limit you set. LinkedIn's User Agreement restricts automated tools, so LinkedIn may limit, restrict or close accounts that use features like this. You connect at your own risk, and we aren't responsible for action LinkedIn takes on your account. Seekpitch isn't affiliated with or endorsed by LinkedIn.

6. AI-written drafts

Emails and reply drafts are written by AI models. They're built to use only the facts you give us in Company & facts and the public information found about each lead, but AI can still get things wrong. Read what you approve. You're responsible for the content you send.

7. Leads and your content

• Your content (your website facts, uploads, imported leads, emails and replies) stays yours. You let us store and process it to run Seekpitch for you.
• Leads Seekpitch finds are for you to work inside Seekpitch while you have an account. They can't be exported, resold or used to build another database.
• You must have the right to use any leads you import, and the facts you give us must be true.

8. Acceptable use

Don't use Seekpitch to:

• Send spam, or email consumers or people who've opted out.
• Promote anything illegal, deceptive or harmful, or impersonate anyone.
• Harass people or collect sensitive personal data.
• Scrape, copy or resell the service or its data, get around plan limits, or try to break or probe its security.

We may pause sending or suspend a workspace that breaks these rules or puts other customers' deliverability at risk. Where we can, we'll tell you first and give you a chance to fix it.

9. The service

Seekpitch, its software and its brand belong to us.

We work to keep Seekpitch running and improving, and we may change or remove features. We'll give notice before changes that take away something you pay for. Seekpitch is provided "as is": we don't promise particular results, reply rates, deliverability or uninterrupted service.

10. Liability

As far as the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost data or damage to sender reputation, and our total liability for any claim is limited to what you paid us in the 12 months before it. Nothing here limits liability that can't be limited by law.

You agree to cover our reasonable costs if a claim is made against us because of emails or messages you sent, or because you broke these terms or the law.

11. Ending your account

You can cancel your plan at any time, and close your account by emailing hello@seekpitch.com. We may close accounts that seriously or repeatedly break these terms. After an account closes we delete its data as described in the privacy policy, keeping only what we need to honour opt-outs and meet legal duties.

12. Changes to these terms

If we change these terms in a way that matters, we'll email account owners at least 14 days before the change takes effect. Using Seekpitch after that means you accept the new terms.
